Terms & Conditions

Introduction

These Terms and Conditions govern the use of courier, logistics, pickup, transportation, and delivery services provided by Seyal Enterprises (“we”, “us”, “our”, or “Company”). By booking or using our services, the customer (“you”, “your”, or “Consignor”) agrees to these Terms and Conditions.

1. Booking & Shipment Information

  1. Customers must provide accurate and complete information, including:
    • Sender and recipient name
    • Complete delivery address
    • Contact number
    • Shipment description
    • Correct weight and dimensions
    • Declared value of the shipment
    • Required documents, wherever applicable
  2. The customer is responsible for ensuring that all information provided at the time of booking is correct.
  3. Any additional charges resulting from incorrect weight, dimensions, address, shipment description, or other inaccurate information may be charged to the customer.

2. Pickup & Delivery

  1. Pickup and delivery services are subject to service availability and applicable geographical limitations.
  2. Delivery timelines provided by us are estimated and may vary due to operational conditions, weather, holidays, customs clearance, regulatory requirements, remote locations, or circumstances beyond our control.
  3. A shipment may be delivered to the recipient, an authorized person, or an appropriate delivery location in accordance with the applicable courier service procedures.
  4. The customer must ensure that the recipient is available to receive the shipment.

3. Domestic & International Shipments

  1. Domestic shipments are subject to applicable Indian laws, regulations, and courier service conditions.
  2. International shipments are subject to the laws and regulations of the origin, transit, and destination countries.
  3. International shipments may be inspected or held by customs or other government authorities.
  4. Customs duties, taxes, clearance charges, storage charges, or other destination-related charges, where applicable, may be payable by the sender or recipient as agreed at the time of booking.

4. Prohibited & Restricted Items

Customers must not send items that are prohibited or restricted under applicable laws, courier regulations, airline regulations, customs regulations, or destination-country rules.

Examples may include:

  • Explosives and flammable materials
  • Illegal drugs and narcotics
  • Weapons and ammunition
  • Hazardous or dangerous goods
  • Counterfeit or illegally obtained goods
  • Items prohibited by customs or government authorities
  • Any other item restricted by the applicable courier, airline, customs authority, or law

The customer is solely responsible for ensuring that the shipment contents are legal and permissible for transportation.

5. Packaging

  1. Shipments must be packed appropriately according to the nature of the contents.
  2. Fragile, electronic, liquid, food, or other sensitive items must be adequately protected by the sender.
  3. We reserve the right to refuse shipments that are inadequately packed or present a risk to other shipments, personnel, vehicles, or facilities.
  4. Additional packaging requirements or charges may apply depending on the shipment.

6. Weight & Dimensions

  1. Shipment charges may be calculated based on actual weight, volumetric weight, or chargeable weight, depending on the service selected.
  2. If the actual shipment weight or dimensions differ from the information provided during booking, the applicable charges may be revised.
  3. The customer agrees to pay any additional applicable charges resulting from such differences.

7. Customs & Documentation

  1. For international shipments, the sender is responsible for providing accurate invoices, declarations, permits, licenses, and other documents required for customs clearance.
  2. Delays caused by incorrect, incomplete, or missing documentation are the responsibility of the customer.
  3. Customs authorities have the right to inspect, hold, assess, reject, or confiscate shipments in accordance with applicable laws.
  4. We do not guarantee customs clearance within a specific period.

8. Delivery Delays

Delivery dates and timelines are estimates and are not guaranteed unless expressly agreed in writing.

We shall not be responsible for delays caused by circumstances beyond our reasonable control, including:

  • Customs delays
  • Government restrictions
  • Weather conditions
  • Natural disasters
  • Strikes or labour disruptions
  • Flight or transportation disruptions
  • Incorrect or incomplete addresses
  • Recipient unavailability
  • Security issues
  • Regulatory restrictions
  • Other force majeure events

9. Shipment Damage, Loss & Claims

  1. Customers should inspect shipments upon delivery wherever possible.
  2. Any claim regarding damage, shortage, loss, or delivery issues should be reported to us within the applicable claim period specified by the relevant courier/service provider.
  3. Claims may require supporting documents, including booking details, invoices, photographs, shipment descriptions, and proof of value.
  4. Liability for loss or damage, where applicable, shall be subject to the terms, conditions, limitations, and compensation policies of the applicable courier or logistics service provider.
  5. We shall not be responsible for damage resulting from inadequate packaging, prohibited items, inaccurate declarations, or the inherent nature of the goods.

10. Payment & Charges

  1. Customers must pay the applicable courier, transportation, packaging, customs, handling, or other charges agreed at the time of booking.
  2. Additional charges may apply for:
    • Remote-area delivery
    • Address correction
    • Re-delivery
    • Storage
    • Customs clearance
    • Duties and taxes
    • Additional weight or dimensions
    • Special handling
    • Return-to-origin shipments
  3. Any applicable taxes will be charged in accordance with prevailing laws.

11. Cancellation & Return Shipments

  1. Cancellation requests are subject to the shipment status and applicable service conditions.
  2. Once a shipment has been picked up, dispatched, or handed over to the carrier, cancellation may not be possible or may involve additional charges.
  3. Shipments returned due to incorrect address, recipient refusal, non-availability, customs issues, prohibited contents, or other reasons may incur return and handling charges.

12. Shipment Tracking

Where tracking is available, customers may use the tracking information provided by us or the applicable courier partner.

Tracking information may be subject to operational updates and may not always reflect the real-time physical location of a shipment.

13. Customer Responsibility

The customer confirms that:

  • The shipment contents are lawful.
  • The shipment does not contain prohibited or restricted items without the required authorization.
  • All declarations and documents provided are accurate.
  • The shipment is properly packed.
  • The sender has the legal right to send the goods.
  • All applicable duties, taxes, and charges will be paid as required.

14. Right to Inspect or Refuse Shipments

We or our logistics partners reserve the right to inspect, refuse, hold, return, or discontinue transportation of any shipment where there is a reasonable concern regarding prohibited items, inaccurate declarations, inadequate packaging, legal restrictions, safety, security, or regulatory compliance.

15. Third-Party Service Providers

Courier and logistics services may involve third-party carriers, airlines, customs agents, transportation providers, or delivery partners.

Service availability, delivery timelines, charges, and liability may therefore be subject to the applicable terms and conditions of those service providers.

16. Privacy

Customer information will be handled in accordance with our Privacy Policy and applicable laws.

Information may be shared with courier partners, transportation providers, customs authorities, government agencies, or other service providers where necessary to provide the requested service or comply with legal requirements.

17. Limitation of Liability

To the maximum extent permitted by applicable law, our liability shall be limited to the applicable liability and compensation provisions of the selected courier or logistics service.

We shall not be liable for indirect, incidental, special, or consequential losses arising from delays, loss of business, loss of profits, or circumstances beyond our reasonable control, subject to applicable law.

18. Force Majeure

We shall not be liable for failure or delay in providing services caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, government actions, strikes, transportation disruptions, customs restrictions, security incidents, or other force majeure events.

19. Changes to Terms

We reserve the right to update or modify these Terms and Conditions from time to time. Updated terms may be published on our website and will apply to services booked after the effective date of the updated terms.

20. Governing Law

These Terms and Conditions shall be governed by the applicable laws of India. Any disputes shall be subject to the jurisdiction of the appropriate courts in Chennai, Tamil Nadu, unless otherwise required by applicable law.
